Terms of Service

Version 2026-10-23.1. These terms apply to every order placed with this version.

In short You send us a story. We write the lyrics and produce a song, using AI-assisted music tools. You get a private link and a licence to use the song. You can cancel for a full refund until we start writing. After that, we fix mistakes for free within 7 days of delivery. Your song stays private.

1. Who we are

Nyumbani Beats ("we", "us") makes custom songs from stories that customers send us. The service is run by the business named on our order page.

By placing an order you agree to these Terms and to our Privacy Notice. You must be 18 or older, or have a parent or guardian place the order for you.

2. What you are buying

You buy a custom song in the package you choose at checkout. The length, files and extras for each package are listed on the order page. We write lyrics from your story and produce the track.

The "ready by" dates on the order page count the songs already in our queue, so they move with how busy we are; the date we show when your payment is confirmed is the one we hold your order to (a Rush order is made before the others). We may stop taking new orders for a while; orders already paid are not affected. If you paid manually before we stopped and send your code while we are closed, we keep your payment and, when we reopen, start your song or refund you if you prefer. A date for the gift to open cannot be earlier than the "ready by" date at the time. While we are closed, you may leave your first name and number to be told once when we reopen.

Delivery times shown on the order page and at checkout are estimates, not promises. We deliver by a private link, usually sent on WhatsApp, so the number you give us must be able to receive WhatsApp messages.

3. Prices and payment

Prices are in Kenya shillings (KES) and are shown at checkout. You pay by M-Pesa. We start your order once your payment is confirmed. You will get an order ID and a receipt code, which you can use to track your order. We issue a KRA eTIMS tax invoice for every sale; if you need it in a business's name, send us its KRA PIN. If someone else pays for your order, the number they pay from can only check that payment on our order page, never your song, your story or anything else in the order: the song and its licence are for the person who placed the order.

With Pay now we send an M-Pesa prompt (through Safaricom) to the number you give. Your order starts when Safaricom confirms the payment. If you cancel the prompt or it fails, nothing is charged and no order is made; you may try again or pay manually. We keep a record of the attempt for 30 days. If money reaches us but we cannot make the order, we will refund it.

Codes: you can use one promo, referral or reward code per order. A code takes money off that order only; it cannot be exchanged for cash, and no code brings an order below half its full price. Codes have a use limit and may have an end date. Your own referral code is for other people; when someone pays with it, you get a single-use reward code for your next song. We may switch off a code that is being misused.

4. Your story and what you must not send us

We may decline or stop an order if we cannot make the song in good conscience. If we do, we refund you in full.

5. How we make your song

We write the lyrics based on your story and use AI-assisted music tools to produce the audio. Voices in your track are synthetic. We do not imitate real artists. Because of how these tools work, results can vary, and a track may sound similar to other music. We cannot guarantee that it is unique.

6. Ownership and your licence

Nyumbani Beats keeps ownership of the master recording and the composition, to the extent any rights exist in them. You receive a licence to use your song, as follows:

We will not license your song to anyone else. The licence lasts as long as you follow these Terms and cannot be transferred, except together with the business it was made for.

When your song is ready, your order page offers a digital licence certificate stating the licensee, the song, the scope above and a licence number. Anyone can confirm a certificate is genuine at our verification address printed on it; that check shows only the scope and issue date, never your name or contact details.

Copyright law on AI-assisted works is still developing. We cannot promise that copyright exists in your track, or that nobody else could make something similar.

Your song is private. We will not list it publicly or use it in our own marketing without asking you first.

7. Cancelling, corrections and refunds

Nothing in these Terms limits any right you have under the Consumer Protection Act, 2012 or other Kenyan law.

8. Listening, downloading and sharing

When your song is ready you open your order with your order ID and WhatsApp number. The listening and download links we show you are private and stop working after about 30 minutes. Open your order again for fresh ones. Anyone who has an active link can listen, so you are responsible for who you share it with.

Download your files and keep your own copy. We do not promise to host your song forever, and we will tell you before we remove it.

A 30-second preview we share while we make your song is for you to judge the sound; it is not the song, it cannot be downloaded, and the link stops working when the song is ready. Your order page offers a printable receipt for your payment; it is not a tax invoice.

The gift page is for the person the song is for. A message you leave for it (words, or a voice message of up to 30 seconds) must follow section 4 like your story. When they first press Play, you are told "Played" with the day; anything else they send back (a reaction, a voice reply of up to 20 seconds) is their choice. A voice reply is the recipient's own recording, made for you: you may listen to it on your order page and keep it to this gift. You may not download it, publish it, forward it or use it outside the gift without that person's agreement. "Make a card" draws a picture on your phone with the song title and their first name; share it as you would the gift link.

9. Our responsibility

We take reasonable care in making your song and handling your information. We are not responsible for indirect or consequential losses. Our total liability for any order is limited to the amount you paid for it. Nothing in these Terms excludes liability that cannot lawfully be excluded.

10. Changes to these Terms

We may update these Terms. Each order records the version you agreed to, and later changes do not affect orders already placed.

11. Governing law

These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction. If something goes wrong, please contact us first so we can try to put it right.

12. Contact
